Ballistic Body Armor Policy
Effective August 1, 2016, TacticalGear.com restricts the sale of body armor and related products (including, but not limited to, concealment body armor, tactical body armor, ballistic plates, ballistic shields, and ballistic helmets) to public safety professionals, members of the United States military, corporate and/or private security officers, and teaching professionals. Orders for such products must be shipped to an approved agency or corporate address. If shipping to an address other than an approved agency, appropriate documentation must be provided. TacticalGear.com reserves the right to refuse or deny the sale of body armor and related products to any individual who is unable to provide appropriate documentation.
By purchasing body armor from TacticalGear.com, you expressly certify and agree that:
TacticalGear.com cannot lawfully ship body armor to customers outside the contiguous United States or to APO/FPO/DPO addresses without State Department approval.
TacticalGear.com cannot lawfully sell body armor to customers in Connecticut and New York, with some exceptions for law enforcement personnel and armed forces members.

TacticalGear.com does not manufacture or control the manufacture of body armor sold online or in-store. The availability of body armor through TacticalGear.com does not indicate an affiliation with or endorsement of any product or manufacturer. Accordingly, TacticalGear.com does not provide any warranties with respect to the body armor that it sells. For warranty information, please contact the manufacturer directly.
TacticalGear.com sells all body armor "as-is" and without warranty, expressly excluding and disclaiming all warranties whether express or implied by law, course of dealing, course of performance, usage of trade or otherwise, including without limitation warranty of merchantability, warranty of fitness for a particular purpose, warranty of title, or warranty against infringement of intellectual property rights of a third party. Check with your jurisdiction to determine if the above disclaimer applies to you.
By purchasing body armor from TacticalGear.com, you agree that TacticalGear.com shall not be liable under any circumstances for any breach of warranty claims or for any damages arising from the manufacturer's failure to honor any warranty obligations.
You assume all risk and liability for your purchase, ownership, and use of body armor, regardless of any oral or written statements communicated by TacticalGear.com, by way of technical advice or otherwise, related to the condition and use of the body armor.
In no event shall TacticalGear.com be liable to you or any third party for consequential, incidental, special, exemplary, punitive, or enhanced damages, or lost profits or revenues arising out of or relating to any alleged breach of these terms and conditions, regardless of whether such damages were foreseeable, whether or not TacticalGear.com was advised of the possibility of such damages, or the legal or equitable theory upon which the claim is based.
TacticalGear.com's sole and entire maximum liability and your sole and exclusive remedy shall be limited to the amount you paid for the body armor purchased from TacticalGear.com.
This limitation of liability shall only apply to the extent permitted by law and shall not apply to liability resulting from TacticalGear.com's gross negligence or willful misconduct.
