Cat5 offers the Site, including all information, tools, and services available, to you, the user, conditioned upon your acceptance of these Terms of Use. Your continued use of the Site constitutes your agreement to these Terms of Use. If you do not wish to be bound by these Terms of Use, please do not use this Site. Notwithstanding the above, in no event shall Cat5's total liability to you for any and all claims, damages, losses, and causes of action exceed the amounts paid to Cat5 by you in connection with the transaction giving rise to your claim.
If you use the Site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. The Site reserves the right to refuse service, terminate accounts, remove or edit content, or cancel orders in its sole discretion. All items purchased from Cat5 are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier.
Accuracy is of the utmost importance to us. However, we cannot guarantee that product descriptions or other content on the Site is 100% error free. If you purchase an item that is not as described, please return it in an unused condition. If a price is listed incorrectly due to a typographical error or an error in pricing information from the supplier, we reserve the right to refuse or cancel any orders for that item.
In addition to any other legal or equitable remedies, we may, without prior notice to you, immediately terminate the Terms of Use or revoke any or all of your rights granted under this Terms of Use. Upon any termination of this Agreement, you shall immediately cease all access to and use of the Site and we shall immediately revoke all password(s) and account identification issued to you and deny your access to and use of this Site in whole or in part. Any termination of this Terms of Use agreement shall not affect the respective rights and obligations of the parties arising before the date of termination.
